By downloading, installing, or using the sPOTS application ("App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. General Wellness Purpose

sPOTS is a general wellness application and is NOT a medical device. The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

The information provided by sPOTS is for general informational and wellness purposes only and should not be considered medical advice. Always consult with a qualified healthcare provider before making any changes to your health regimen.

3. Eligibility

You must be at least 13 years old to use sPOTS. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent that you meet these eligibility requirements.

4. User Responsibilities

When using sPOTS, you agree to:

Provide accurate information when logging symptoms and intake
Not rely solely on the App for medical decisions
Seek professional medical advice for health concerns
Use the App in accordance with all applicable laws
Not attempt to reverse engineer or modify the App

5. HealthKit Integration

sPOTS integrates with Apple HealthKit to read heart rate and HRV data. By granting HealthKit permissions, you authorize sPOTS to access this data solely for the purpose of providing wellness insights. You can revoke these permissions at any time through your device settings.

6. Intellectual Property

All content, features, and functionality of sPOTS, including but not limited to text, graphics, logos, and software, are owned by sPOTS and are protected by copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Pattern predictions and insights are generated by on-device machine learning models and may not accurately reflect your actual health status. These should never replace professional medical evaluation.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, sPOTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO ANY HEALTH-RELATED DECISIONS MADE BASED ON APP INFORMATION.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through an in-app notification or by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
